Welcome to Cerca! These Terms and Conditions (“Terms”) govern your access to and use of the Cerca mobile application and services (collectively, the “App”) provided by Cerca (“we,” “us,” or “our”). By downloading, accessing, or using Cerca, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use Cerca.

Acceptance of Terms

By using Cerca, you agree to comply with these Terms and any additional terms and conditions that we may provide in the future. If you do not agree with these Terms, you must discontinue use of the App.

Account Registration and Security

• Account Information: To use certain features of Cerca, you may be required to create an account, provide accurate information, and maintain it.
• Security: You are responsible for maintaining the security of your account, including keeping your login credentials confidential. Cerca is not responsible for any losses arising from unauthorized use of your account.

User Content and Conduct

• User Content: Cerca allows you to add, organize, and manage information such as location names, favorites, and visit statuses (“User Content”). You retain ownership of your User Content, but you grant Cerca a limited license to use, display, and distribute it solely to operate and improve Cerca.
• Conduct: You agree not to misuse Cerca or engage in behavior that could harm the App, other users, or third parties. Prohibited activities include but are not limited to:
  • Impersonating others or misrepresenting your identity.
  • Uploading or sharing false, harmful, or inappropriate content.
  • Accessing or using the App for any illegal purpose.

Location-Based Services

If you enable location-based features, Cerca may access your device’s location data. This information is used to enhance your experience by suggesting nearby locations. You can disable location services at any time through your device settings, but doing so may limit Cerca’s functionality.

Intellectual Property Rights

• Ownership: Cerca, including all content, features, and functionality, is the exclusive property of Cerca and its licensors.
• Restrictions: You may not copy, modify, distribute, or create derivative works based on Cerca or its content without our express permission.

Disclaimer of Warranties

Cerca is provided “as is” and “as available” without any warranties, express or implied. We do not guarantee that Cerca will be error-free, uninterrupted, or secure. Your use of Cerca is at your own risk.

To the fullest extent permitted by law, Cerca and its affiliates will not be liable for any damages arising from your use or inability to use Cerca, including, but not limited to, direct, indirect, incidental, punitive, or consequential damages, even if we have been advised of the possibility of such damages.
